:confused:Dear All,

I am still on H1 (not utilized EAD), the visa on my passport expired last year. Planning to visit India next week, should I be getting a visa stamped or use AP?

APPRECIATE INPUTS FROM THE EXPERIENCED/SIMILAR SITUATION. Any USCIS link will also help.

I have analyzed the tracker from Rajiv Khanna's site. Here are some inputs.


Cases transferred from federal offices :
There is no set trend in processing of these cases. There are a substantial number of approvals.

Cases transferred from SWA offices :
There is clear trend here. The last 3/4 months PBEC has sent out approvals from mid 2002. There are a number of PD June 2002 approvals and some PD July, august, september '02. There is an effort to push mid 2002 cases in PBEC.
The folks left over from 2001 may receive NOF or some query. I am not sure.
If you are a SWA cases from 2001 you should be talking to someone...your lawyer...employer...

I have mailed my 485 on july 16th and NSC recieved it on july 17th.My question is looking at the TSC processing times which says July 18th,is my application already preadjusted,485notice date is september 15th.Can anybody tell me how the processing date really works.

Arrived in early 1999
started processing GC in 2000
filed 1st application in 2000
left the company, filed second application in 2001
bad immigration management by the company, got the labor approved only in October 2006
got I 140 in February 2007
applied for I485 in June 2007
got EAD on September 2007
got GC approval email on August 5th, 2010
FINALLY GOT GC ON AUGUST 16th, 2010

It is not even considered yet and I don't think it will ever be considered. That amendment includes not only schedule A but also others and with proposal to increase the number as well.

How could it pass if it's carrying heavy-baggage, it won't move!!!

I don't think that was an issue ever. Also keep in mind the new PIM process which is now part of visa stamping might delay things if you go to get a visa stamped

Hi,

I talked to my lawyer and she didn't mention about any kind of delay so can you please give me some more details about this PIM and how does it affect the whole process and slow things down.

That should give an idea how many members are really "active" on IV.

Though IV core is doing a wonderful job as volunteers, no wonder why there is why there are only few active participants. I have asked my friends to join IV (some of them already joined during '07) they say that it is occupied by few senior members and anyone speaks against them or come up with any suggestions, they will

--> contribute time and MONEY and there are many seniors who do not update their profile and still didn't donated a dollar....
--> If you speak up loud, you are an anti- and criticize until you leave the thread...

They say that it has become hangout joint for few and they rule...no suggestions from new comers are entertained here...IV is just depending on CIR which is known to fail from all fronts and IV is not working towards smaller bills....

There is no official process or filing fee. Attorneys generally represent both the employer and the employee. Because revoking the petition could harm the employee, a conflict of interest arises. Accordingly, most immigration attorneys would not want to be involved in assisting in the revocation of petitions.

Do you mean to say, the employer just sends a letter with a signature and LIN numbers to revoke and USCIS revokes them?

In that case does USCIS send a confirmation of revocation of all the requested LIN numbers to be revoked? Or it is just a one-sided handshake?

Can somebody explain me why this disco guy and this Villamonte guy are even on this forum ??? We are sitting here for 9-10 years telling our folks in our home countries, I'll come in may, no probably july, no in july my papers goes for renewals,, may be Dec. no in Dec. tickets are too expensive and in March I have my project live date, may be next may oh no by then I'll have to send my papers for renewal.... well you know what, forget about me, you stay happy where you are and I live happily here....

And these people are telling us USCIS is doing what they should be doing...

I don't think its June 2007. If it means all EB3 categories and not just EB3 Mexico then it means June 2008
