I have a approved I-140 with company A. It is a substitute labor.
I am getting laid off end of the month and I have a new offer from company B.
Can I port priority date of this I-140 to new company B? Does porting work for substitute labor also?
Thanks

Utah legislators passed two measures Friday that set the state on a different course than Arizona. One measure is an enforcement one and would require police to check the immigration status of those stopped on suspicion of committing felonies and misdemeanors. The measure's most controversial provision - an Arizona-style section allowing police to stop people based on a "reasonal suspicion" that the person is illegally present - was removed. The bill is making headlines as well for inclusion of a guest worker provision that will allow the state to issue two year work permits to persons illegally present in the...

My friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.
Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.
Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?
Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?
If anyone has any info on this, it'd be truly appreciated.

A Federal Judge has certified a nationwide class in a challenge to the USCIS's restrictive interpretation of the "automatic conversion" clause in the Child Status Protection Act (CSPA) of 2002. This opens the way for children who have "aged-out" to be reunited with their parents. The USCIS has resisted implementing this important section of law for the past seven years. Just a few weeks ago, the Board of Immigration Appeals (BIA), in Matter of Wang, adopted the government's restrictive interpretation of the automatic conversion clause. On July 16, Federal Judge James Selna (Central District, California), over government objections, made his...

This article is very interesting. The legal immigration dropped even though the applications flooded in last year.

A new report from the Economic Policy Institute makes the case that immigrants at all wage levels actually lift wages for US workers:A key result from this work is that the estimated effect of immigration from 1994 to 2007 was to raise the wages of U.S.-born workers, relative to foreign-born workers, by 0.4% (or $3.68 per week), and to lower the wages of foreign-born workers, relative to U.S.-born workers, by 4.6% (or $33.11 per week). In other words, any negative effects of new immigration over this period were felt largely by the workers who are the most substitutable for new...

I recently got my I797 approved (on Oct 19) but, the USCIS denied my extension of stay, and I need to go for stamping in Chennai (as per I797). My question:
1. Can I attend the interview in Canada/Hyderabad consulate instead of Chennai. Company attorney said that should be ok and filing I824 for change of consulate would take long.
In case you wanted to know more details about my case:
-Possess I797 from Employer A until Nov13, 2009.
-Filed for H1b extension with Employer B in Feb, denied in Jun15. payroll with Emp B Feb onwards.
-Re-filed for extn with Emp B in Aug4 finally approved on Oct19 but denied extn of stay.

It's Groundhog Day in Las Vegas, as immigration attorneys convene for the first day of the annual conference of the American Immigration Lawyers Association -- for many of us, regrettably, a victory of hope over experience. This is not intended as a smackdown of AILA. On the contrary, AILA has assembled an all star cast of speakers and is offering a collection of cutting-edge immigration topics. Rather, the reference to the film is more a commentary on the annual uttering of unhelpful, straight-faced responses by most (but not all) of the agency officials on the dais to the pressing concerns...

My 485 is under processesing with a priority date of March 2006.
I was browsing through the instructions to e-file my I-131 (Travel document) and found this interesting point and was a little confused.
This is from USCIS website
You are not eligible to electronically file this form if:
You have a pending I-485, Application to Register Permanent Residence Status or Adjust Status currently at a USCIS office and you are eligible to file the I-131 for no additional fee.
Does this mean we can no longer file for I-131 online...? I did this last year and didnot have any issue's. Any thoughts/opinions/experiences are highly appreciated. Thanks

gcformeornot is correct. You cannot "transfer" an I-140 approval, but you can keep and use the PD for any subsequent I-140. Once a new LC is approved, a copy of the I-140 approval notice with the 10/2007 PD should be included in the new I-140 submission along with a request to use the old PD on the new I-140 approval notice.

As we prepare to extend healthcare insurance to another 40 million people in the U.S., do we have enough physicians to care for them? According to the U.S. Department of Health and Human Services, over 25% of our population lives in medically-underserved areas where there is less than one primary-care physician for every 3,500 patients. Even under our present healthcare system, the Association of American Medical Colleges projects a deficit of 159,000 physicians by 2025. At least 15 medical specialty societies have released studies projecting shortages in their fields. The American Academy of Family Physicians predicts a shortage of 40,000...

Hello folks,
I am on H1 B visa. I want to change my last name. If any H1 B visa holder has changed his/her name in US, please let me know the procedure and probelms encountered during the process.
My second question is - I have valid H1B visa stamp on my passport, If I change my name, do I have to go out of the country to get my visa stamp again ?

The D40 requires an AF-S lens as far as I know, I have never actually used one. I know it will work wit the D70. I recommend trying it out before buying it if that is possible. It works on the D70 by setting everything to manual. Good luck
