I would like to register my protest with you for not following an orderly method when approving I-485 applications. In the last two months, while the priority dates were current for several applicants from India in the EB2 category, most applications with later priority dates and later receipt dates were approved by USICS, causing deep concern and grief among those waiting patiently in the line before them.
This significantly reduces our confidence in the system. Thus, I am sending you this letter with a book as a symbol of protest and with the hope that USCIS will deal fairly with all the applicants as per the rules and regulations.

This bulletin seems to have a more-detailed-than-usual write-up on PD movement and projections. It'll be interesting to see how ppl interpret the comments from Dept of State regarding projections.

I am hoping they just dont tie EB2 I and Eb2 C at 15th Feb 2005 in April 2009.
Previously we have seen bulletins where Eb2 I and Eb2 C have tied up at 1Apr2004.
I dont know how many iterations it will take before it reaches the RIR/PERM boundary(1 Apr 2005)
We know predicting visa bulletin movement is next to impossible (for anyone) with even a semblance of a proven record (over a long period of time)...
But we still can't turn our heads away and resist the temptation to make an attempt, so here goes...for a tickle, if not anything else...

i think AC21 is a law passed by congress. So no matter how it is but it has to be followed by USCIS.
Now a days USCIS staff doen't have correct knowledge about AC21 so with out understanding they are rejecting.
Initially I got my H1 extension only for 1 year even though my 140 is approved and 485 filed. Then i fought to USCIS and showed the pdf doc from AC21 which states that they have to issues 3yrs extension.
Then they issued for 3yrs.
It is all lack of knowledge abt AC21.

Frankly I am not Australian and I dont care about the friendship your country has with US. Every Country is sucking up to USA for favourable relationship...

27,370 members have zero to 10 posts.
That should give an idea how many members are really "active" on IV.
Though IV core is doing a wonderful job as volunteers, no wonder why there is why there are only few active participants. I have asked my friends to join IV (some of them already joined during '07) they say that it is occupied by few senior members and anyone speaks against them or come up with any suggestions, they will

It looks like they have heard from IV members about the spillover rules and their clarification about the QUARTERLY spillover is useful. Also them categorically stating that any spillover visas would be used in strict order of PD is reassuring. Whether they actually practice or not, it is good that they have gone on record as saying that is the way it should be.
In the past spillover was not applied in the way they are saying and EB2I suffered greatly for it.
This spillover rules if enforced will accelerate EE2I movement initially and then EB3. I suspect that by this summer EB2I folks from 2007 should be seeing some action.

I re-read the section and I think your interpretation is correct. All I-140 filed after introduction and approved before enactment should stand clear from this provision. If there is an I-485 petition filed along with such an I-140 that is approved before enactment of this act, then it will qualify for an immigrant visa whenever one is available under the old law.
Again one needs to run this interpretation through a lawyer to be absolutely sure.
Hmm so I was quite worried about good old Section 502(d)(2) at first, but after re reading carefully, this may not be terrible. I (and others?) might have pressed the panic button a little too quickly.
As I read it now (and I am NOT a lawyer), any I-140 petition adjudicated after the effective date of this legislation (Oct 2008 seems to be the popular opinion) will be rejected if the I-140 petition has a filing date after May 15th 2007. If this *only* applies to adjudication of I-140s and NOT to I-485s, this means that you would have to have filed your I-140 after May 15th and have it still pending by Oct 2008 .... 14 months for folks filing in the near future. This is quite unlikely, as it takes only a month or so for premium processing, and around 6 months for non-premium.
Folks might get into trouble if they have a labor certification stuck in the BEC and it doesn't get approved for another 12 months or so...

Typically, if someone is doing a AC21 jump + H1b transfer, it means that the h1b gets transferred to the new employer and the new employer is the h1b petitioner. If the h1b is based on an approved 140 - the beneficiary gets it for 3 years and unless the person is completing his 3 years with the new employer when the 140 revoke happens, the h1b is still valid unless the new employer decides he will cancel it or the person is layed off and thats when the person is in deep trouble because he/she does not have EAD. Correct me if I am wrong. H1b revocation by ex employer may not affect the candidate because candidate already did a transfer

Ths USCIS site says the following ....
"....The current fee schedule will apply to all applications filed under Visa Bulletin No. 107 through August 17, 2007. (The new fee schedule that becomes effective on July 30, 2007, will apply to all other applications filed on or after July 30, 2007)."
Does that mean if I file 485 on Aug1st I have to pay new fees?

We can predict EB2 movement but EB3 is kind of gone case for this year too. Without any CIR, we can just pray that EB2 for all countries become current or at least move until july fiasco date (Aug 2007) so that spillover starts trickling to EB3.
Since EB2 I/C after Aug 2007 PD haven't filed their I-485 yet so the visa numbers if any left out by clearing until Aug 2007 should go to EB3I (the most retrogressed country). I don't see it happening this year but in 2010 it's a possibility.
