I am a donar and was able to access donar forum till some time back. But for some reason I dont seem to have access to the donar forum. Are the policies changes or is there a mess-up in the membership credentials

Hi All,
I was with company A until March 23rd 2008 and changed to company B (they filed my H1B transfer as well as extension on 03/24/2008 with vermont center). USCIS didnt process my case until mid of september 2008 and my employer B raised a service request. After 15 days of service request i got a query on my H1B i.e on 09/30/2008. Query was replied on 10/30/2008 but haven't received any response until now and aslo the status hasn't been changed in the website.
On the other side my I-94 expired on August 18th 2008. Its been exactly 120 days until now that my i-94 got expired and came to know from others that i can stay in US for 240 days maximum after my I-94 expiration.
Could you please help me out what are the options i have here with respect to the H1B and also regarding the I-94. Your help is highly appreciated. Plzzzzzzzzzzz help me out.

Conclustion: "This Court finds that the FBI owes no duty to an applicant to process his or her background check. Absent a duty to the applicant, neither the Mandamus Act nor the Administrative Procedures Act confer jurisdiction on this Court over the FBI. Without an independent basis for jurisdiction over the FBI, and since the Declaratory Judgment Act does not confer jurisdiction, this Court is without subject matter jurisdiction to review any decisions or actions of the FBI regarding its processing of a background check for CIS that is related to immigration matters."
It seems that suing FBI becomes ineffective now.

I would like to invite my brother to US for a 2 month road trip I am planning in April.
I finished my employment in Jan and currently on 6 months B2 visa. I got my NZ residency approved and I will be leaving US in June at the end of road trip. I have been living in US for past 10 years (3 years on F1 and 6.5 years on H1B). I am 32 unmarried/male/Indian from Hyderabad.
My brother is 33 and is married with a 3 year old daughter. He manages my dads businesses (rental properties, finance, farm etc.). I am pretty sure he has some properties on his name.
I would like to know what are his chances of getting visa approved.
What do I need to provide him as support and what does he need to provide as support documentation ?? What does US consulate look for support typically and to what extent ?
I would really appreciate if anyone can give some advice especially someone who were successfully able to get a US visitor visa to their brother.
Thanks in advance.

The U.S. Department of State (DOS) reports that no later than April 30, 2010, all non-immigrant visa applicants worldwide will be required to use web-based form DS-160. The DS-160 form will combine the previous forms DS-156 and DS-157 and 158. Since not all U.S. Embassy’s and U.S. Consulates have implemented form DS-160, all consular posts that are not currently utilizing the DS-160 Web-based form will eventually be instructed to implement the DS-160 between March 1, and April 30, 2010. To review the list of the 24 consular posts currently using the new form DS-160, please visit

I got an email from USCIS saying my I-485 case is now transferred to National Benefits Centre and is now pending standard processing at a USCIS office.
I am travelling to India currently and plan to re-enter on AP.
I wanted to know if
1. anyone has any ideas as to what this really means, anyone received similar email, experiences?
My priority date is not current so are they pre-adjudicating my case or planning to send a RFE??
2. Should I take any specific steps while re-entering on AP?
Thanks

Hello everyone,
I had come and been living in California since Feb 2010 under F1 visa.
My mom filed the form I-130 to petition me last year when my PD was current (Dec 2010), I filed the form I-485 to AOS. I got fingerprint done and was issued the EAD card plus a valid SSN and Alien number also. And last week I just got the INterview done at the local USCIS. Unfortunately, the officer said because the retrogression of visa bulletin, my PD wasnt current anymore, and all the paperwork was sent to NBC to be saved there and when my PD comes, they will issue me my GC.
I am currently going to school, and Im wondering if Im qualified for FAFSA, and am I considered as CA resident so that I dont hav to pay out-of-state resident?
Also, I will be filling out my transfer application to a university this FALL (Im going to a Community College now), what should I write for my immigration status and etc?
I will rly appreciate ur feedback!

Hi,
Apologies if this is a repeat question:
I have extended my H1B (approval received) but my visa stamp expires in June 06. I have EAD (not using it) and plan to apply for AP. If I travel outside the country (with AP, of course), do I need to get a new HIB visa stamp to reenter? Can I show my AP, and 485 pending papers to come in as a parolee and still retain my H1B? Or my H1B status will get cancelled if I use AP?
I hear conflicting opinions from different people and I don't when I would be need to travel to India for family reasons. If anybody has been in a similar situation, please let me know your experience.

folks
I got my EAD last October (filed for my I-485 on July 02, '07) but did not apply for my AP then;
Now I need to apply for my EAD renewal and am also thinking of getting an AP. Do I need to get an AP for the current year (that is for the time period from Oct '07 to Oc 08) and then apply for AP extension or can I directly apply for AP for Oct '08 to Oct '09?
the second option will save me money and so for me that is the preferred one :D
any information on this is much appreciated,
thanks,
karthik

I was pleased to learn about this web site. Here's how DHS describes the TRIP program: The Department of Homeland Securitys Travel Redress Inquiry Program (DHS TRIP) is a single point of contact for individuals who have inquiries or seek resolution regarding difficulties they experienced during their travel screening at transportation hubs--like airports and train stations--or crossing U.S. borders, including: denied or delayed airline boarding denied or delayed entry into and exit from the U.S. at a port of entry or border checkpoint continuously referred to additional (secondary) screening Why DHS TRIP? DHS TRIP is a central gateway to address...

Hello,
I Need an advise on my H1-B extension.
I came to USA on on L1 Visa in 2003/March and I was on same visa till Dec/2003. ( 9 months).
In 2004 Jan I filed H1-B and my status changed from L1 to H1-B. Again I filed 2nd extension (for next 3 years) on this H1-B and I got this approval upto given till 2010 Jan.
My question here is can I wait upto current H1 - B approval validity even though total stay on L1 + H1-B is exceeding the 6 yrs ?
OR do I need apply for H1-B extension on my approved I-140 (curently in 485 stage of my GC) to get 3 more years extension as 2010 Jan will be my 7th year in USA ?

Hey,
I'm F1 right now, graduating in may. I'm not sure if i'm going to work or go to school after graduation. If I apply for OPT then get into school again as an F1 student, is my current F1 visa void (valid to 2012) ? Will I have to get a new F1 visa because I applied for OPT?
Thanks in advance
Huggi
