My wife will be applying for H4 visa (1 st time) some time in march. I am currently working on H1B in US.
while checking the website for documents required for H4, they ask for the Photocopy of the Principal Applicant�s valid visa.
Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
I would appreciate if you could reply me on this regard.

Hi,
My situation -
I am a homemaker on H4 since 2007. ( My husband on H1 ).
Doing MS on H4 ( with few credits still to go )( not full time ).
H4 is due stamping ( Already extended till 2012 ).
Objective -
- To be on F1, to utilize CPT / OPT.
QUESTIONS -
QUESTION - - Which one is better H4 to F1 in US via change of status - I-539 ( BUT That
way i had to face the consulate again for F1 stamping ( Also, very few
credits are left with my MS as in now ))
OR
Directly F1 Visa stamping at
US consulate in India ( It'll be surely fast, that way i won't have to go back for stamping with very few credits left ) ?

Folks,
I am trying to put together documents for my wife's 485 application. The birth certificate was re-issued a couple of years back (with corrections to her mother's name and including her last name which was missing earlier).
The lawyer says we need to put a good reason down for 'why a corrected birth certificate was not obtained until now'.
Do you guys know of a good reason to provide USCIS? Know of any reason which was accepted in case of your friends?
Please do advise. Thanks!

Hi all. I'm looking for a little help with part 2 of I-485. I've sent off my I-140 and I am hoping to apply adjustment of status concurrently. I wondering which box to fill in part 2. A. looks the closest, it reads: 'an immigrant petition giving me an immediately available immigrant visa number has been approved. (Attach a copy of the approval notice......)' My trouble is this: If my I-140 is approved then my visa number is no problem, it is current for my category/country (outstanding professor/Canada). Since the I-140 is pending, this looks like the wrong box, however, none of the others look even remotely close. Any help would be greatly appreciated. Bark

Both my wife and I are working on H1B visa.
We are landing in Canada for H1B visa renewal.
However, the nvars.com appointment system allows 1 primary applicatnt and then allows to add dependents to that application. Should I add my wife as a dependent or create an independent primary applicant profile for her since she would be requesting an H1 B renewal as well.
If I create an independent primary applicant profile for her, I may not be able to get the same visa date / appointment for both of us.
Please guide.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

Here is a scenario:
Previous I 140 (EB2 PD Sept 2005) approved and is now current
Current I 485 filed based on another I 140 with PD in Dec 2006.
Can port over to the previous I 140 and can make I 485 current. The issue here is still unmarried so would like to hold on for few months to port over the PD.
Do you see an issue if porting is not done from EB2 Dec 2006 to the PD in EB2 Sept 2005?
How does it work if married after 3-6months and then want to port the PD for the spouse as well? Does Previous I 140 PD current still hold good?
If retrogression occurs once again do u still need to wait to port and get Green Card

Later on I got L1-A visa from my company A in Feb 2008 and came to USA on L1-A visa in Feb2008 and working for comany A till date on L1 visa.
Now I want to change my status from L1A to H1-B to join company C .
My H1 petition is valid till 2010 October. My questions are
1. Can I change my status from L1A to H1B any time before October 2010(H1b expiry date).
if not, How many months before I need to change from L1 to H1b before my H1b petition expires.
2. My current project is still ongoing till October,2010 and I am with L1 status. so Can I wait till October and then apply for change of status to join new company C on H1-B visa.
Need your help.

Hello All,
I will be appearing for L1 individual visa extension in chennai in a few days from now.
One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?
Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.
Please advise as it would help me in responding with correct answer. Thanks.

My labor and 140 are approved. 485 is pending.
Can I go to India and come back , say just 5 months before my PD comes current.
e.g. the EB2 is now hanging at March 05 . My PD is at Oct 05. When it comes to around Aug 05 ...I will come back and start working.
I have to fight some litigation there .I have my AP Documents and EAD all right .
my Q is WILL THIS CAUSE RED FLAGS ON MY 485 APPLICATION. As long as I was in US I was employed. But I was out of US for my own personal situation.
Please advise

I applied for fresh EAD I-765 in Jan 2011....it is still in initial review stage.
M on L2 visa (dependant of L1)......and bcoz of some urgent reason ,here onwards i cant stay in US any more.
So,
1. Is there any provision for taking back application of I-765?(means i spent $380 for I-765,so can i get it return?)
Plz ....i need suggestion as early as possible!!

You cannot file for a new EAD more than 120 days before the old one expires. You are within that 120-day period, so I would apply ASAP.

Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?
