Just saw this story from a few days ago. Aside from being a hugely irresponsible way to spend a broke state's taxpayer funds, this idea also is probably unconstitutional. Does Arizona plan on having its own border control points? Will the state's wall interfere with Border Patrol activities? The federal government is supposed to control the national borders and not the states. Not that Arizona minds wasting the state's money to continue to losing that point.

One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. But the timing of a major scandal involving Customs and Border Patrol certainly will make many people question just who the agency is hiring. This evening, news media outlets are reporting that Solicitor General Elena Kagan will be the nominee to replace Justice John Paul Stevens on the US Supreme Court. Kagan was asked last summer by the Supreme Court to opine on whether the high court should hear a challenge to the constitutionality of the 2007 Arizona employer immigration sanctions law. Kagan has so far not provided an answer and she'll no doubt be asked about this. She'll also likely be asked about the new Arizona law.

I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

No, you can not. there are lot more factors than your qualification.

Hi All,
I am in the fourth year of mu H1b, and I need to start my GC process. My current employer is a consulting firm which provides services to a third party main client. My questions are :
a) is this a good time to file for GC given the fact that my company falls under employer-employee relationship memo?
b) I plan to go to India in summer and need to get my stamping. Will the new memo from USCIS affect my stamping? My current h1b expires in sept 2011.
c) If I apply for my GC before going to India in summer, does it affect point b ?
Thanks to anyone who can answer my questions.

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. When one applies for AP in Multiple entry category they will be given 2 AP dox. lets say if one has used both on travelling like both has stamp of POE can they reuse the same for future travel with in the one year period of validity ?

I am planning to visit India for a10 days in October. I have a valid h1b status till 2010 which I thinking of getting stamped at new delhi. But it seems the PIMS verification delay is making people wait for weeks and months. I have an AP which I can use to enter as an alternative. But I wanted to know if anyone had experience in stamping at the delhi consulate? Do they keep the passport if it is send for PIMS verification? In that case I'll drop the idea of getting it stamped and use my AP (though I want to avoid doing that snce I want to maintain my h1b status).

everyone here talks abt geting GC asap.. even though most of us are swearin at the USCIS/DOS whtevr, deep down we all want GCs. but after thi sJuly VB, do u have faith/trust in the system now? assume that they accept our application and what if they give out GCs 2-3 yrsfrom now, what makes u think they cant come back and say it was a mistake and u have to give ur GC back?
If they can do what they did today, and get away with it, they can do anything. its no differnet from Telgi scam/Laloo gobar/chara scam, so many scams in india. they get away once, they get away again. the middle class/average/educated tax payers like us suffer.

Immigration and Customs Enforcement Assistant Secretary John Morton announced today that the agency will inspect the I-9 records of approximately 1000 companies around the US, dwarfing the announcement in July that nearly 600 firms were being investigated. Only 500 firms were audited in 2008. This time the employers being targeted are firms involved with "critical infrastructure" projects.
