You will be out-ofstatus. And you need to find a job before 30-day grace period (it depends on the person who is handling your case) and move back to H1. Otherwise you cab either change to a different visa category if possible else you have to find a job and get your H1 through consular processing which happens to visit your home country get the visa stamped and comeback to US.
I am not sure about your previous H1B. if they have revoke your h1 then you cant do anything.
This is my opinion. But you can wait what others to say about this.

Hi,
Background filed H1 extension on Jan 2009 got approved Mar 2009, Got Approved I129 , Got the stamping H1B done in India. Online I129 status was still pending - Ignored that since I got the physical approval notice.
Feb 2009 changed Employer and started working on EAD, on June 3 the online status for I129 has been updated to Denied.
I am checking with my former employer to see if they withdrew my H1 (They typically don't withdraw H1).
I have not filed AC21 with my new employer.
Questions :
1. I have heard of online status still being in pending status even though its been approved. Have anyone heard of its getting denied ?. What are the implications ?.
2. There was a soft touch on my 485 on April 28. and i have not filed for AC21. Should i file AC21 ?

I am currently on L1B visa since Mar09, another employer is offering for my h1b visa. I have below queries for l1 to h1 conversion process :
1) How much time I can stay on H1 if I apply H1b now ? My total stay in US on L1 is 1 year 7 months, not a continuous one !!!
2) What are the good options/approach to file for H1 considering the fact that I want work with current employer on L1B for current project ?
3) Can I apply for H1 now and later do COS any time after October ?If yes, what is the max time before I need to do COS after H1 approval ?
4) How about if my current project completes before oct 1st and I have already applied for h1 ?
Kindly help me for above questions, would appreciate your help.

AILA's 03/15/2007 Liaison Meeting minutes reflect the following statistics:
Total Cases Pending: 96,304

Hello,
I have a h1b visa that will expire in March 2010. This visa has been already renewed for its second time so, as you know, I wont be able to renew it once again.
Currently I am applying for permanent residency ( EB3 category) and I am in the AOS phase. I have the possibility of renewing EAD's every year, but I need to understand what is going to happen when the H1b expires. Can I renew EAD's even after the visa is no longer valid? How does it work?

So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? I had L1A from 10/2005 to 10/2008. My lawyer filed I-485 in 2008, but he did not file extension of L1A. My L1A is expired in 2008. In Jan. 2010, my I-485 was denied. We filed appeal in Feb.. Then, we filed L1A extension, which is denied in June 2010. I do not know what to do? I have been in here for five years. now my wife and child's L2 also expired. Can I file another L1A without leaving USA (I was told no, because I did not meet 1/3 requirement, one year abroad within three years of admission into the USA. I have to go back Jamaca for one year and refile there, but I would give up my I-485). Thanks.

Here is my situation wrt to I 140 and EAD.
1. I am on 6th year of H1 this year and my H1 expires on 30 Sept 2010. I have to apply for H1 extn this year.
2. My employer started GC process (EB3) in 2006 on substitute labor of Aug 2005. He applied I 140 in April 2007.
3. He applied EAD when they are current during June, July 2007 based on substitute labor. I and my wife got EAD eventhough my I 140 is pending.
4. As old I 140 is pending he applied another I 140 with different EB3 labor for me in 2008 and both new labor and I 140 got apporved. He ported my A# of EAD card to this new I 140 showing as beneficiay on it.
5. My old I 140 is still pending and USCIS didnt send any query on that till date. My employer is confident on getting approval of old I 140.
Here are the questions I have:
Can I work on EAD by taking full time jobs by applying AC 21? Does it safe to work on EAD?
If my old I 140 gets any problem what are consequences with my GC process?
Can anybody answer, Please.

I had a H1-b visa until September 2008 from Company A. I transferred the H1-B to Company B and it was approved in December 2008. When I went for my stamping in March 2009 it was denied under 221(g). My employer then withdrew the H1-B petition because of lack of projects. I am now planning to apply for a B1/B2 visa at the Mumbai Consulate. Any one have a similar experience to share or have an idea on my chances of sucess?

Can some one reply to my post please. My question is regarding EAD only. Once I apply for EAD and go to India what happens
1. If I am not there while it approved? Can my frnd send me the EAD to India?
2. if I get called for finger printing for EAD and if dont go for it? Will my AOS will be treated as abandoned?

I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?
