    Guys,

I have created a search engine (http://immisearch.blogspot.com/) to help all people looking for a better way to search topics around immigration related activites. The search engine came as a result of my countless hours that I spent searching to answers around the web.
Try searching for any information with h1b, h4, Green Card, I-485, I140, citizenship etc, and the engine should give you a better result.

Leave a comment at the blog and let me know what else could be improved.
    http://immisearch.blogspot.com/

Also find out what people are saying at other threads..

You don't need a transit visa for London. Couple of days ago my friend went via London with AP and expired visa on passport.

    From Greg Siskind's blog:

In its press release, USCIS did not state how cases filed and rejected on the 2nd are to be handled other than to say that properly filed applications would be accepted. This presumably covers the many cases filed after the second that were held, but it doesnt explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. Hopefully, again, USCIS will institute a process for such individuals to avoid being penalized.

USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 Regular cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.

As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

Seeing no downside, more lawmakers reveal details of their work schedules (http://thehill.com/leading-the-news/seeing-no-downside-more-lawmakers-reveal-details-of-their-work-schedules-2007-09-18.html) By Jonathan E. Kaplan | The Hill, September 18, 2007

Do you know where your congressman is? Until recently, few aside from staffers could have answered yes. But under increased pressure from watchdogs and the public, more lawmakers are disclosing with whom theyre meeting, as well as when and where.

Rep. Kirsten Gillibrand (D-N.Y.) is a case in point. For instance, she had two hectic days of meetings, receptions and fundraising events at the end of May.

On May 30, she met with American Insurance Group (AIG) officials, attended a meeting with Goldman Sachs employees to discuss sub-prime lending and alternative energy policies, sat down with Altria Group lobbyists to discuss tobacco regulation, and joined some of her business-friendly Democratic colleagues to meet with Morgan Stanley executives.

She then hopped on a plane for a two-day fundraising swing through San Francisco and Los Angeles, where she attended a fundraiser with Sen. Hillary Rodham Clinton (D-N.Y.) and raised money for herself.

This information normally is hard to come by for a reporter or government watchdog group. But during last years campaign, the Sunlight Foundation, a new watchdog, challenged lawmakers and candidates to publish their official work schedule online within 24 hours of the end of the workday.

My sixth sense about this is that greater transparency is an antidote to corruption and members of Congress get that, the executive director of the Sunlight Foundation, Ellen Miller, said. [California Republican Rep.] John Doolittle is a case in point. Were at the tip of the iceberg. More and more will do it as citizens begin to understand it.

Gillibrand agreed to make her calendar public during the 2006 campaign, making it easier to see how she is using her time. Sen. Jon Tester (D-Mont.) also started posting his schedule when he arrived in Washington even though he did not sign the pledge, his spokesman Matt McKenna said.

For Tester, open government is a way of life in Montana, McKenna said, adding that the reaction has been all positive.

Six more lawmakers, Reps. Alcee Hastings (D-Fla.), Kathy Castor (D-Fla.), Jan Schakowsky (D-Ill.), Denny Rehberg (R-Mont.) and Doolittle and Sen. Bill Nelson (D-Fla.), have followed suit.

The calendars provide a glimpse into the harried lives of the lawmakers, showing with whom they meet and how they manage their time and highlighting differences between the House and Senate.

They also allow observers to link campaign donations to meetings.

Gillibrand flew to Palo Alto, Calif., on May 30. A week earlier she gave $4,600 to Clintons presidential campaign. On June 2, Gillibrand met the calendar does not say where with Jayne Shapiro, a wealthy businesswoman, who gave $500 to the campaign. Gillibrand also met with Marsha Kwalwasser, an executive at Northrup Grumman, according to CQ Moneyline.

Reporters and constituents love publicly posted schedules, and so do opposition researchers. MajorityAP.com, a Republican Web-based research service that provides information to reporters about Democratic lawmakers, accused Gillibrand of misleading the public by not stating where the event took place.

Its reasonable that the people in her district know that shes in California raising money during the Memorial Day recess, the websites founder, Michael Brady, said.

A spokeswoman for Gillibrand said the missing location was a simple oversight, adding that Gillibrands office would look into adding the location.

Miller said Testers schedule should be the standard that lawmakers emulate, but that more disclosure is better than none.
Tester shares the same frenetic pace as Gillibrand, traveling, presiding over the Senate, sitting in committee hearings, meeting with constituents and huddling with Sen. Max Baucus (D-Mont.).

    Take June 21, for instance.

Tester started the day at 9 a.m. with his senior staff, then attended a Senate Indian Affairs Committee hearing, met with a delegation from the PPL Corporation, presided over the Senate floor and lunched with former NBC anchorman Tom Brokaw.

The lawmaker returned to his office to meet with constituents, hit the annual ice cream social, chatted with more constituents including the winner of the National Peace Essay Contest and met with an official from the American Bankers Association. He and Baucus huddled at 3:30 and the Senate met at 11 p.m. that evening.

While editorial boards and government watchdog groups have praised the postings for adding transparency to the political process, each calendar has its shortcomings. Gillibrand and Schakowsky, for example, do not specify at what time each appointment occurred. Tester does not identify some people; Rehberg and Doolittle do not detail the time they spend politicking or raising money; and Hastings only lists his weekly schedule.

Most lawmakers do not archive their schedules, although Congresspedia does.

Castor, however, lists the times of her meetings and includes information on fundraising events she attends. She began posting her schedule in March.

Shes a very strong supporter of open government, Castors spokeswoman, Agustina Guerrero, said.

    Hi,

If the labor from BEC gets approved and subsequent I140 as well, is it possible to request only the priority date change for the I485?

Not refering to replace the I140. IS IT POSSIBLE TO JUST REQUEST THE PRIORITY DATE?

    Yes.

Please check and verify details with your attorney/lawyer. This is NOT a legal advice.

    1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

It will be counted in the quota

    2. How sure about getting approval of H1B.

Well, if you have a job offer for which you qualify and all relevant supporting documents, I dont see why you wont get the approval.

A traitorous American general hanged for aiding the British during the Revolutionary War -- one Benedict Arnold -- said rather cynically: "Law is whatever is boldly asserted and plausibly maintained." This quote came to mind in scanning the latest developments in dysfunctional immigration: With a rider passed by the House to a defense appropriations bill, Congress is poised to approve the phased elimination of the U.S. military's "Don't Ask. Don't Tell" policy. House leaders champion its action as a long-overdue recognition of the civil rights of gay soldiers. Yet the civil rights of binational gay lovers -- trashed by the...

    Hi All,

My wife is on H1 since Oct 2009. No paystubs. Now she want to come back on H4. Her H4 stamping expired. I have my H1 renewed in Oct 2009 and need stamping.

What are the best and low risk options to convert to H4 status. Please advice

    Thanks

When did her latest I-94 expire?

She most likely is out-of-status for a long time (more than 6 months). Also she started/would start accruing illegal/unlawful presence from the day her I-94 expired/expires. Talk to a lawyer before doing anything.

Conservatives Launch Caucus (http://www.rollcall.com/issues/53_52/news/20766-1.html) By John Stanton | ROLL CALL STAFF, October 31, 2007

Frustrated by what they see as a party gone astray, a group of House and Senate conservatives led by Sen. Jim DeMint (R-S.C.) and Rep. Jeb Hensarling (R-Texas) today will announce a new bicameral caucus aimed at returning fiscal restraint, ethics and national defense to the fore of the GOP's philosophical and policy platforms.

The group - which in addition to DeMint and Hensarling is made up of Sen. Tom Coburn (R-Okla.), Rep. John Shadegg (R-Ariz.), Rep. Paul Ryan (R-Wis.), Rep. Tom Price (R-Ga.) and Rep. John Campbell (R-Calif.) - will officially announce the creation of their new caucus - dubbed Reagan21. They also will unveil their "statement of policy commitment," which includes 10 key positions on issues ranging from Congressional earmarks to health care reform.

While participants are billing the new caucus as a complement to the leadership teams in place in the House and Senate, Republicans familiar with the project acknowledge that to a certain degree it is a challenge to Senate Minority Leader Mitch McConnell (R-Ky.) and House Minority Leader John Boehner (R-Ohio), because implicitly the call for a new direction is a rejection of the course they have steered along with President Bush.

"When you're saying, 'Here's the vision of what the party should be,' you're saying the vision isn't there right now," said a House Republican not directly involved with the effort.

A second Republican agreed, arguing that a more broad change in how the party runs is needed.

"Whenever there's a vacuum in elected or political leadership, there's a need to fill it. When you have leadership positions not resulting in leadership, people will go elsewhere," the second Republican said, adding the problems of the party go far beyond simple messaging conflicts.

"It's a fight for [the GOP's] soul, not just a superficial divide. There are people who believe it's the job of Republican Members to come here and send money home to their states and to expand government. And that's just not what rank-and-file party members want."

Today's announcement of the group's principles for reform of the Republican Party are the first in a series of steps that the caucus will take over the next several months. Members are in the process of setting up independent outside institutions - similar to the Congressional Black Caucus Foundation - to support their activities, and they will have a Web site up and running in the next few weeks.

Although details of those plans were unclear at press time Tuesday, one member of the group said the caucus will use the foundation as a semi-independent apparatus to communicate with Republicans outside Washington, D.C., as well as the general public.

Although members of the group declined to comment on the caucus on the record, one Member involved said the lawmakers believe the GOP's elected leaders have strayed from the party's traditional fiscal conservative roots.

"A few of us here are trying to change the culture" of the GOP, the lawmaker said, adding that "the core values of the Republican Party are not being adhered to by the party inside Congress. But there's a yearning for it outside the Beltway."

According to Republicans familiar with the effort, it arose from meetings between DeMint, who chairs the Republican Steering Committee in the Senate, and Hensarling, who chairs the Republican Study Committee in the House. Both organizations are the hub for conservative efforts in the chambers, and following the disastrous 2006 election, DeMint and Hensarling began holding meetings in an effort to better coordinate their efforts.

Eventually, the two began to bring other lawmakers into these Member-only meetings. Following months of discussion, the group decided to start the caucus, choosing a name that would invoke the core fiscal principles of former President Ronald Reagan for the 21st century.

The principles - which new members will be required to make a pledge to follow and which will be the centerpiece of the group's legislative and public outreach efforts - cover a wide variety of issues. For instance, members of the caucus will be required to foreswear asking for any new earmarks in legislation. The principles also call for reforms to the tax code and entitlement programs, including the implementation of personal "ownership" of retirement security and health care decisions, according to a copy of a document obtained by Roll Call. Members of the caucus also will support expansion of intelligence and other national defense programs, as well as an aggressive border security approach to immigration.

While all of the members of the group would likely fall under the broad rubric of "social conservatives," the principles steer clear of issues like abortion or gay marriage. According to those involved in the effort, members of Reagan21, according to one, have decided that while those issues are important to them, they have decided to "focus on the fiscal policy issues that I think really killed us last year."

Republicans privately also applauded the decision to stay with traditional fiscal issues rather than expand the group's focus into social topics. One source noted that while most base Republican voters are fierce social conservatives, many independent voters and disaffected Democrats - who agree with the GOP on fiscal issues and ethics - are turned off by the party's heavy tilt toward its social wing.

According to GOP aides, the group has operated under strict confidentiality rules as it has hashed out how it will operate and what its mission should be - so much so that staff continue to have only a sketchy idea of what their bosses are envisioning. Additionally, the members of the group have agreed to not tip their hand to either Boehner or McConnell before today's news conference, although they have begun reaching out to like-minded Members in the House and Senate to join the group.

The formation of the caucus is the latest in a series of breaks between conservatives, particularly in the Senate, and the party's traditional power centers this year. DeMint and Coburn have openly and repeatedly attacked "Old Bulls" in the party like Sen. Ted Stevens (R-Alaska) for their use of earmarks. Additionally, conservatives openly broke with their leaders this spring over the immigration bill.

The Reagan21 member cautioned that the caucus's critique of current GOP positions should not be seen as members "tak[ing] a swipe at anybody" in leadership positions. "They've got a tough job and it's hard to get your arms around the whole party" in a way that could facilitate reform, the lawmaker explained, adding that Reagan21 participants see themselves as "the conscience of the Republican Party here" in Washington.

But reform will be key if Republicans are to avoid further electoral loses next year, this member said.

"Unless the Republicans get together and define themselves we're going to get caught in fog. ... I don't want to be Democrat-lite," the lawmaker said, adding that the group hopes to attract Members who have long been fiscal conservatives as well as new recruits. Reagan21 hopes "that a lot of these Republicans who like to think they can have it both ways - go home and talk like conservatives but come here and vote for whatever they want - will be forced to come to our side. We can't continue to allow a few people in our party continue to pervert what we are about."
