    Hi All

    I am currently working for Company A and have an approved I-140 with Company B, PD May 2004, EB2 category.

    Company B applied from my H1- transfer last week, not under PERM though.

    I do not yet have the receipt number of the H1 transfer and it may take 2 to 3 months for the actual H1 transfer to happen.

    With the PD current, I have the following questions

    1> Do I have to wait for the actual H1-transfer to finish before filling my I-485 or is it OK to start the I-485 with a receipt #?

    My guess is the I-485 is an adjustment of status and since GC processing by an employer is for future employement it should'nt even matter if I am an employee when filling I-485 with the employer.

    Can some experts/ senior members comment and throw some light on the matter.

    What will the answer to the question Current immigration status while filing EAD electonically, i am on EAD rite now and i have never used my advance parole.* Pls help..
    In e-file this question is not mandatory, so I guess we can leave it blank in case we have doubt.

    My company changed address while my transfer H1b petition was pending. We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.

    The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

    You cannot use the “AUTO VISA Revalidation” rule once you go for stamping.

    Please share your experience of H1b visa stamping in Halifax or Quebec (Canada).
    I am planning drive to Halifax or Quebec end of this month.
    I am intended to use “AUTO VISA Revalidation” rule.
    I am from India and I don’t have any U.S. degree.
    Any suggestions.

    Hi,

    Background filed H1 extension on Jan 2009 got approved Mar 2009, Got Approved I129 , Got the stamping H1B done in India. Online I129 status was still pending - Ignored that since I got the physical approval notice.

    Feb 2009 changed Employer and started working on EAD, on June 3 the online status for I129 has been updated to Denied.
    I am checking with my former employer to see if they withdrew my H1 (They typically don't withdraw H1).

    I have not filed AC21 with my new employer.

    Questions :

    1. I have heard of online status still being in pending status even though its been approved. Have anyone heard of its getting denied ?. What are the implications ?.

    2. There was a soft touch on my 485 on April 28. and i have not filed for AC21. Should i file AC21 ?

    I work full time and will continue to work with same employer in the near future, despite having switched to EAD. However, I will use AC21 if a substantially better opportunity presented itself.:)

    Gurus,

    I have 2 questions

    1) When do I have to apply for the 140 after the labor approved; what is the max time allowed after labor approval.

    2) Name Correction in labor; what is procedure to correct my approved labor certficate and when/how to do this ...

    I was just checking my H1b extension status and it seems that it got approved (3 weeks time). while looking for my H1b extension status i happen to find the link below,

    USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/)

    It gives the processing trends by month based on trends or volume of application processed. This dashboard is for all applications forms submitted to USCIS, you can select form type, office and chart type. Data can also be downloaded in CSV raw format for analysis.

    He is my attorney for my GC process. He had successfully done my PERM application last year and now we are processing I-140 from last 4 months. Best thing is that he is quick and his paralegal call/email you whenever they miss any document instead of waiting for long time and going thru employer channel which consumes lots of time in between.

    I130 petition shows an "immigrant intent" so that could come up as a ground of not allowing a person into the U.S. on a purely non-immigrant visa. I would suggest to speak to an attorney.
