USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. Right now, employers have to go to all the trouble of preparing a case that may be rejected simply because the visa allocation is filled. I think...

Hi,
I need some urgent advise. My wife has got a Biometrics appointment notice for 8th Jan. She is in India currently and scheduled to return on 24th Jan. We have already got the appointment rescheduled once (original notice was for 1st Dec). When we got it rescheduled we asked them to give us the next appointment after 1stFeb, but they ignored that part!
I wanted to know can I get it rescheduled again? Will it have any impact on her 485 application? Do I need to enclose any cover letter explaining why i need to reschedule? Any personal experiences with rescheduling the appointment more than once?

As long as the Master Program in UK is equivalent to Masters in US, you should be good.
You can get your credentials evaluated in US and see if its a Masters equivalent.

Hi,
Do we have to pay the issuance fee if we are getting stamping in India. I am getting my H1B stamping in chennai. I am in my 8th yr of H1B.
Can any one please inform me about this ? Also if any one recently had their stamping done, can you please post your experience.

This bill has provisions for Schedule A workers (nurses) not for EB green card.

Hi
I have applied for I-140 thro Substitute in March 2006(15 months ago) and I got a query on my education and company financial status in August 06 and attorney replied back to query in the month of October 2006.
When I check my status online shows as "we received your application on October 20th 2006 and in process".
Last month there was an updated date on 05/25/07 on my case and when i checked with employer, he says we have not yet received any information from USCIS to attorney.
Now the attorney says, we will be Re-filing my case, as one case got denial from my company (Not mine itseems). So that we will get new Receipt Number as I have only 8 Months left on my H1 and we can apply for 1 year extension meanwhile before 6 months of H1 expiry.
Is it a good idea to re-file I-140 from the same Service Center(NSC)?
or Can I apply in PERM now as I have only 8 months on my H1.
Pl. suggest.

If your I-140 is approved then you can renew H1B for 3 years, else it will be in one year increments.
You can continue to keep h1B as long as an underlying GC application is pending.

I dont think this means anything. With the huge influx of AP and EAD applications - I am quite certain that the last thing on USCIS's mind was making sure that the LUD was kept updated for the 485 apps. The important thing is that you have your 485 receipt and that is the acknowledgment that they have recieved the application and its in order.

According to the mathew ohio website. there is apparently a very hot legal battle going on between the DHS and a happless immigrant who had been arested for out of status presence. The immigrant was on an H1b and had filed an application in a timely manner and was awaiting decision on his application when the DHS official arrested him and tried to deport him. Please post more information on this issue if anybody is aware of it. His I-94 expired, however, his petition for H1b extension was pending!!!!:o:o:o

Bush is visiting Csico, San Jose. There is a huge EB community in Cisco afftected by retro. I talked to my friend there and he said guys were planning to ask one question about this to Bush. Apparently ther was lot of activity around this . Any update guys ? Any one from Cisco pls respond

My PERM was filed during July 2008 and got audited. I've got my H1B 7th year extension up to Dec 2010 (including recapture time). Now what will happen if my PERM is denied say on March 2010?
Should I leave the country immediately on March 2010 or Can I stay in US till H1B validity i.e. Dec 2010?
Any inputs would be appreciated.

Well need some help. I moved from H1-B to F1 visa to do masters. Now I want to quit F1 in middle and go back to doing H1-B and continue masters part time.
I know there are still slots open for H1-B for 2010. Please correct me if I am wrong.
Now I can do summer internship untill August 26, the question is, how can I work for the employer for the month of September? since H1B starts on Oct 1st. I can do CPT full time but, then again I heard you can not quit CPT in middle of the semester.
Any suggestions will be greatly appreciated.

Yes you should furnish this info. One of the forms asks for details of previous marriages which you should provide. I think you will also need to provide your divorce decree. Providing the information does not impact your application one way or the other.
